The Bite:

Trump signed an executive order titled:
"Promoting Advanced Artificial Intelligence Innovation and Security."

It directs federal agencies to build a voluntary framework that gives the government up to 30 days of access to new models before releasing them. The order explicitly bars mandatory licensing, preclearance, or permitting for AI model releases.

It also creates an "AI cybersecurity clearinghouse" led by Treasury, in coordination with CISA, NSA, and the AI industry, to coordinate vulnerability scanning and patch distribution.

The NSA director will run a classified benchmarking process to determine which models qualify as "covered frontier models."

• Earlier drafts gave the government 90 days of pre-release access, but the final version cut it to 30

• Musk, Sacks, and Zuckerberg reportedly lobbied the White House to block the stricter version last month

• The NSA director decides what counts as a "covered frontier model" via classified benchmarks, no public criteria

Why it Bites:

The word "voluntary" is doing enormous structural work in this executive order.
And it probably won't hold.

OpenAI published its Frontier Governance Framework recently, a document that basically said:

Two days later, Washington signed an order that kind of replies:

“Actually, we'd like to see the model first.”

So, here's the thing:
The order says no company has to participate.
But the framework gives the government a role in picking "trusted partners" who get early access, and provides zero public criteria for how those partners are selected.

If you're an AI company preparing an IPO, or courting enterprise clients, or selling to the government itself, opting out of a voluntary framework run by the NSA and Treasury isn't really opting out.

The NSA director now runs a benchmarking process (classified) that determines which models trigger the framework.

No public threshold. No published criteria. Just a designation that arrives from behind a clearance wall and reshapes your release timeline.

The soft leash is the point.

Because a mandatory oversight can be challenged in court, debated in Congress, or slowed by politics. But a voluntary framework that every serious company feels compelled to join…

That just becomes the floor very quietly, without a vote.
