❌ One State Just Banned The ’Nudifiers’

The Bite:

The Minnesota Senate passed House File 1606 on April 30 with a 65-0 vote, making it the first U.S. state to outright ban AI nudification apps.

The House had passed the bill the previous week.

The law prohibits the access, download, or use of any website, app, or software designed to generate nude or sexually explicit images of real people using AI, unless the output involves substantial human artistic skill and control.

It empowers the state attorney general to levy fines of up to $500,000 per violation and gives victims a civil right of action to sue app developers for damages.

The bill now awaits Governor Tim Walz's signature.
Advocates expect him to sign it.

Why it Bites:

Minnesota just passed the first law that goes after the tool itself.

Not the person sharing the image, not the platform hosting it, but the developer who built the one-click undressing machine in the first place.

That's a meaningful shift.

Every prior attempt at this, federal or state, targeted distribution or possession.
This one targets the supply chain.

The question is whether it survives.

The Trump administration has explicitly said it will challenge state-level AI regulation, and the White House framework released in March calls a patchwork of state laws a threat to innovation.

A 65-0 bipartisan vote in a state legislature is hard to argue politically.
But legally, federal preemption is the loaded gun in the room.

If the DOJ task force picks this fight, the first state to ban nudifiers could become the test case for whether any state can regulate AI tools at all.

And then there's the part nobody in Washington wants to say out loud:

Congress had its shot.
The DEFIANCE Act passed the Senate twice and died both times in the House.

The Take It Down Act made distribution a crime but left the apps untouched.

Minnesota filled the gap because the federal government didn’t.
