The Bite:

Anthropic is in federal court in San Francisco today, arguing for a preliminary injunction against the U.S. Department of Defense.

This stems from Anthropic refusing to let the Pentagon use Claude for autonomous weapons and mass surveillance.

It then got slapped with a "national security supply-chain risk" designation (a label historically reserved for Huawei-tier foreign threats), and decided to sue.

Judge Rita Lin is hearing arguments for a preliminary injunction right now.
No ruling yet.

• One day after the designation was finalized (March 4), a top Pentagon official emailed Amodei saying the two sides were "very close" on the exact issues now cited as national security threats.

• Anthropic's CFO estimates the designation could cost the company multiple billions in 2026 revenue.

• 22 retired military officials filed amicus briefs calling the move "retribution against a private company."

• Microsoft filed its own brief backing Anthropic.

• OpenAI signed a Pentagon deal hours after the ban, reportedly accepting the same three safety red lines Anthropic was blacklisted for holding.

• CENTCOM confirmed this week that U.S. strikes on Iran are being run with "advanced AI tools", but didn’t name which ones.

The Pentagon finalized the "national security risk" label on March 3.

In the very next day, one of its own officials told Amodei they were basically aligned on the same issues.

If OpenAI's contract can include the same AI safety restrictions Anthropic was blacklisted for holding… What legal standard actually separates a national security concern from a procurement dispute dressed in national security language?
