The Bite:

Pennsylvania Governor Josh Shapiro signed Executive Order 2026-05 on August 18.

The order makes his Governor's Responsible Infrastructure Development (GRID) Requirements legally binding on data center developers.

Developers must sign a Consent Order and Agreement with the Department of Environmental Protection (DEP) before permit review begins.

DEP will not issue a permit until a project has secured all required local approvals.

All data center projects are removed from the state's Fast Track permitting program, and nondisclosure agreements are no longer permissible.

Shapiro acted after the Republican-led state Senate declined to vote on legislation codifying GRID.

• More than 100 data center proposals are under discussion in Pennsylvania, 58 of them engaged with DEP.

• Only five projects hold every permit needed for a first phase of development.

• Developers must pay the full cost of new generation, transmission, and distribution serving their projects.

• Non-compliant developers lose the existing sales and use tax exemption on data center equipment.

• Under the order, data centers lose electric service before other customers when the grid is stressed.

• Archbald, a borough of 7,500, is facing six proposed campuses made up of 51 warehouses.

Why it Bites:

DEP won't touch a permit until the township signs off, which gives a borough of 7,500 the same stopping power as a state agency.

A local no is now a state no.

Developers have been shopping sites for months without naming the tenant or saying where the electricity comes from.

Shapiro: "That practice ends today." 

Once the hyperscaler's name has to appear at the zoning hearing, the fight stops being about a nameless LLC and becomes about a company with a brand to defend.

Only then the money moves.

Growth pays for growth, data centers get shed first in a grid emergency, and refusing the requirements costs you the tax break.

Pennsylvania is still open for the buildout. It just stopped being cheap, fast, or quiet.
