🍭 The $134B Breakup Goes To Trial ⚖️
Musk, Motives & Money Mayhem

Good morning. Tech founders really are just theater kids with equity.
Let’s dive in 👇
🍭 What’s Cookin’:
Musk vs. Altman goes full courtroom drama
Google drops $40B on Anthropic
Meta loads up on AI chips (not GPUs?)
Musk vs. Altman
➗ OpenAI Divorce Hits Court
The Bite:
Elon Musk and Sam Altman's lawsuit went to trial in Oakland federal court.
A nine-person jury was seated under Judge Yvonne Gonzalez Rogers, with opening arguments set for today.
Musk alleges Altman and OpenAI president Greg Brockman deceived him into funding OpenAI as a nonprofit, then pivoted it into a for-profit behind his back.
He's seeking up to $134 billion in damages + the removal of Altman and Brockman from their roles and a reversal of the company's corporate restructuring.
OpenAI, now valued at $852 billion, calls the suit baseless and motivated by competitive jealousy tied to Musk's own xAI.
Snacks:
Musk originally donated $38M to help found OpenAI as a nonprofit in 2015
Brockman's 2017 diary entry surfaced in court: "This is the only chance we have to get out of Elon's orbit"
The trial is split into two phases: liability first, then remedies
Ilya Sutskever, Mira Murati, and Satya Nadella are all expected to testify
Musk was held liable last month by a separate jury for defrauding investors during his $44B Twitter takeover
SpaceX plans to IPO this summer; OpenAI is targeting its own public offering by year-end
Why it Bites:
This is a $134 billion custody battle over a company neither party runs the way they originally promised.
Musk says he was conned into funding a charity that became a money machine.
OpenAI says Musk wanted to be CEO, got rejected, then launched a competitor.
Both versions can be true at the same time, and that's the uncomfortable part.
The diary entries and internal docs read less like corporate governance and more like a group chat nobody thought would leak:
Brockman journaling about escaping Musk's orbit.
Altman privately reassuring Musk the nonprofit was safe while planning otherwise.
Musk proposing to absorb OpenAI into Tesla.
Everyone was angling. Nobody was the altruist they claimed to be.
The real question is not who lied.
But whether the nonprofit structure ever meant what any of them said it did, or whether "for the benefit of humanity…"
…was always just the pitch deck for the most expensive breakup in tech history.
