🌎 Two Laws, One Issue, Opposite Bets on AI
The Bite:
In the same week, two governments published major AI policy frameworks.
They point in opposite directions.
In Brazil, the ECA Digital (Law nº 15.211/2025) took effect on March 17.
It requires digital platforms, such as social networks,
games, and streaming services, to protect minors by design.
It includes:
biometric age verification,
mandatory parental controls,
banned behavioral advertising targeting children,
and prohibited manipulative recommendation algorithms for under-16s.
Enforcement falls to Brazil's data protection agency (ANPD), with fines up to 10% of a company's Brazilian revenue.
In the US, the Trump White House released its National AI Legislative Framework on March 20.
It’s a four-page document, recommending Congress preempt all state AI laws, shield developers from open-ended liability, and formally declare that training AI on copyrighted content does not violate copyright law.

The US framework explicitly limits developer liability for third-party misuse of their models. The same liability shield logic that made Section 230 controversial for 30 years
The White House declared that AI scraping copyrighted content is not a copyright violation, deferring all disputes to the courts.
Both frameworks address child safety. Brazil made it an obligation.
The US made it a recommendation.
Why it Bites:
The real story here isn't Brazil vs. the US.
It's two completely different theories of how to govern technology that's already in children's hands.
Brazil's bet is liability by design: if your algorithm hooked a kid, that's your legal problem.
The platforms have to build safety in before launch, not apologize later.
It’s still imperfect, but the direction is clear.
The burden sits on the company, not the family.
The US framework does the opposite.
It shields developers from liability, kills state-level regulation, and leaves the messy questions for the courts to sort out.
The word "innovation" appears as the primary justification.
The word "accountability" does not.
Here's what's worth watching: the ECA Digital specifically targets recommendation algorithms and behavioral profiling, which is just AI with a friendlier name.
Brazil didn't write a law about AI. It wrote a law about what AI does to children.
That's a smarter framing.
It'll be harder for platforms to dodge.
The US framework, meanwhile, essentially bets that the tech industry will self-regulate at the speed of congressional gridlock.
But that's not a bet, it's a delay.
Two governments. Same problem. Very different answers.
