⚖️ Altman Finally Takes The Stand
The Bite:
Sam Altman testified Tuesday in the Musk vs. OpenAI trial in Oakland, called by OpenAI's defense team.
He followed Monday's appearances by Microsoft CEO Satya Nadella, co-founder Ilya Sutskever, and board chairman Bret Taylor.
Closing arguments are expected Thursday, with jury deliberations to follow.
Musk is seeking the removal of Altman and Brockman, the return of profits to the nonprofit, and up to $134B in damages.

Sutskever testified he wrote a 2023 memo describing Altman's "consistent pattern of lying", then signed a letter supporting his reinstatement anyway, calling it "a Hail Mary"
Nadella revealed a 2022 internal email comparing the OpenAI deal to IBM's PC partnership. He didn't want Microsoft to "become the next IBM"
A Brad Smith memo projected a $92B return on Microsoft's $13B cumulative investment, with a 20% annual escalator starting in 2025
Sutskever disclosed his stake in OpenAI's for-profit arm is worth roughly $7B
Altman told the jury he almost didn't co-found OpenAI because he thought Google was too far ahead to compete with
Taylor testified the board unanimously rejected Musk's bid to acquire OpenAI last year
Why it Bites:
The trial was supposed to be about whether OpenAI betrayed a charitable mission.
Three weeks in, it's turned into a live-action org chart of who got rich and how.
Sutskever holds $7B in equity from a company he tried to blow up.
Nadella feared becoming IBM but stayed anyway because the alternative was worse.
A projected $92B return on $13B doesn't sound like charity math.
And Altman, the man accused of stealing a nonprofit, almost didn't show up because he thought Google had already won.
Every witness has made the same argument without saying it:
The nonprofit structure was a vehicle, not a destination.
If the jury buys that, Musk loses the case but wins the point.
OpenAI's IPO can proceed, but with a trial transcript that reads like a cap table confession.
The next fundraising deck will have to explain why a company born as a public trust…
…needed five billionaires to testify that this is where it was always headed.
