🏛️ California Now Watermarks Your AI Videos

The Bite:

California's AI Transparency Act took effect on August 2.

The law covers generative AI systems with more than one million monthly users that are publicly accessible in the state. Covered providers must embed a hidden "latent disclosure" in every AI-generated image, video, and audio file.

They must also give users a visible "manifest disclosure" option and run a free public AI detection tool.

The requirements do not apply to AI-generated text.

Penalties run $5,000 per violation, with each day counting as a separate violation, enforced by the state attorney general.

Snacks:

• Latent disclosures must carry the system name, its version, and the date content was created or altered.

• Detection tools must accept file uploads, URL submissions, and API calls, and cannot retain user personal information.

• Providers licensing their systems must revoke a licensee within 96 hours of learning disclosures were disabled.

• Large online platforms must detect and display embedded provenance data starting January 1, 2027.

• Camera and recorder manufacturers selling in California must enable disclosures by default from January 1, 2028.

• Pending amendment SB 1000 would delete the one-million-user threshold entirely.

Why it Bites:

Every media clip from a covered provider now ships with a hidden serial number.

In January 2027, the big platforms have to read those numbers and display them.
In January 2028, camera manufacturers have to stamp their own.

Stack the three dates and you get the thing California didn't say out loud:

The default flips.

In two years, unstamped won't mean "human", but "unverifiable."
